Terms of Service
These Terms of Service ("Terms") govern the purchase of website design services and the monthly Care Plan (together, the "Services") from Josue Trujillo ("I," "me"), based in the Sacramento, California area. By clicking "purchase," completing checkout, or otherwise engaging the Services, you ("you," the "Client") agree to these Terms.
1. The Services
- Website Build (one-time fee): a custom website based on the preview shown to you, revised with your requested changes and launched on your domain.
- Care Plan (monthly fee): website hosting, SSL security, backups, one professional email mailbox at your domain, and reasonable small content updates (text, photos, hours, and similar changes). Larger work — new pages, redesigns, new features — is quoted separately before any charge.
2. Payment
The one-time build fee is due to begin launch work. The Care Plan is billed monthly in advance through my payment processor (Stripe) and continues until cancelled. Prices in effect at checkout apply; I will give at least 30 days' notice before any change to your monthly price.
3. Cancellation & refunds
You may cancel the Care Plan at any time, effective at the end of the current billing period; there are no cancellation fees and no long-term contract. Because the website is custom work you previewed before purchase, the build fee is non-refundable once the site is launched. If you cancel the Care Plan, hosting and the email mailbox end with your billing period, and I will provide your website files within 14 days of your request.
4. Your content
You are responsible for the accuracy and legality of the content you provide or approve (text, photos, logos, credentials, claims), and you confirm you have the right to use it. I may decline content that is unlawful or misleading. You retain ownership of the content you provide.
5. Ownership
Once the build fee is paid in full, the finished website design and its files belong to you. Your domain name is registered in your name or transferred to your ownership on request — it is always yours. Hosting and email accounts run on service accounts I manage; they are part of the Care Plan rather than transferable property, but your files and your domain always move with you. I may display the completed website in my portfolio unless you ask me not to.
6. Third-party services
The Services rely on third-party providers (such as hosting, domain registration, email, and payment processing). I choose and manage reputable providers and keep backups, but I am not responsible for outages, changes, or failures of third-party services beyond my reasonable control.
7. What I don't promise
I promise professional work, honest communication, and responsive maintenance. I do not guarantee specific business results, search-engine rankings, traffic levels, or uninterrupted availability.
8. Limitation of liability
To the fullest extent permitted by law, my total liability for any claim arising out of the Services is limited to the amounts you paid me in the twelve (12) months before the claim, and neither of us is liable to the other for indirect, incidental, or consequential damages.
9. Term & termination
Either of us may end the Care Plan as described in Section 3. I may suspend or end Services for non-payment or unlawful use after reasonable notice.
10. General
These Terms are governed by the laws of the State of California. If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with your checkout confirmation and any written proposal, are the entire agreement. I may update these Terms from time to time; the version posted at josuetrujo.com/terms at the time of your purchase applies to that purchase.
